Who is Protected?
A Protective Order is available to individuals who have been abused by, among others, a family or household member or a current or former sexual or intimate partner. New Hampshire law defines “abuse” as certain criminal acts (like assault, criminal threatening, harassment, etc.) that constitute a credible present threat to the petitioner’s safety.
Key Provisions
If granted, a Protective Order can include a wide range of relief, including:
- No Contact: Restraining the Defendant from contacting the Petitioner, their family, or household members, directly or indirectly (including electronic communication).
- Stay Away: Restraining the Defendant from entering the Petitioner’s home, workplace, school, or other specified locations.
- Exclusive Residence: Granting the Petitioner temporary, exclusive use and possession of a jointly owned or shared residence.
- Weapons Relinquishment: Requiring the Defendant to immediately surrender all firearms and weapons to law enforcement for the duration of the order.
- Temporary Custody/Support: Issuing temporary orders regarding child custody, visitation, and financial support.
